By accessing or using Swaply (swaply.studio, the “Service”), operated by Swaply LLC (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Swaply is an AI face swap tool for short-form video. You upload a photo of a face (the “Source Photo”) and either paste a public TikTok or Instagram Reel URL, or upload your own video file (the “Target Video”). Swaply generates a new video with the face from your Source Photo placed into the Target Video.
You must be at least 18 years old to use Swaply. By creating an account you represent that you are 18 or older. If you are using Swaply on behalf of a company, you represent that you have authority to bind that entity to these terms.
You must provide accurate information when creating an account. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are used fraudulently.
Swaply is offered on a monthly subscription basis. Each plan includes a fixed number of face swaps per month, HD output, and no watermark. Current plans and pricing are listed at swaply.studio/pricing. We reserve the right to change pricing with 30 days’ notice to existing subscribers.
Each video face swap counts as one swap against your monthly allowance. Unused swaps do not roll over to the next billing period. Swaps consumed by failed jobs due to our error will be refunded to your allowance.
All payments are processed through Stripe. Subscriptions are billed monthly in advance. All amounts are in US dollars. You are responsible for any applicable taxes.
Subscription fees are non-refundable except as required by law. If Swaply experiences an outage exceeding 24 consecutive hours that prevents you from processing swaps, email hello@swaply.studio and we will issue a pro-rated credit or refund for the affected period.
You may cancel your subscription at any time. Upon cancellation, your subscription remains active until the end of the current billing period, after which your account reverts to a deactivated state and your data is retained for 30 days before deletion (see our Privacy Policy).
Swaply is a powerful tool, and how it’s used matters. You agree that you will not use Swaply to:
We reserve the right to suspend or terminate your account immediately and without refund if we determine that you have violated these rules. Repeat or egregious violations may be reported to law enforcement.
You retain ownership of the Source Photos and Target Videos you provide, and of the face-swapped output videos Swaply generates for you.
You grant Swaply LLC a limited, worldwide, non-exclusive, royalty-free license to host, store, process, and transmit your Source Photos, Target Videos, and output videos solely to deliver the Service to you (including through our AI model provider for the duration of processing).
By uploading any Source Photo or Target Video, you represent and warrant that:
You are solely responsible for how you use, publish, distribute, or share the face-swapped videos Swaply generates. We recommend disclosing that a video is AI-generated when you share it publicly, and complying with the disclosure rules of the platform you post to.
If you believe content processed or stored by Swaply infringes your copyright, trademark, right of publicity, or other right, send a takedown request to hello@swaply.studio including: (a) your contact information, (b) a description of the right you claim and the specific content at issue, (c) the URL or swap ID, and (d) a statement under penalty of perjury that you are authorized to act on behalf of the right-holder. We will investigate and respond promptly, and will remove content where appropriate.
Swaply is powered by generative AI, which has inherent limitations:
The Service — including the Swaply name, logo, website design, code, and documentation — is owned by Swaply LLC and protected by intellectual property laws. Nothing in these terms grants you rights to our trademarks or brand assets.
Swaply integrates with Supabase, Stripe, Google Sign-In, an AI face swap model provider, and public video platforms (TikTok and Instagram) when you paste URLs from them. We are not responsible for the availability, accuracy, or conduct of those services. If a third-party provider changes its terms, pricing, or availability, we may modify or discontinue related features.
We strive to maintain high availability but do not guarantee uninterrupted service. Swaply may be temporarily unavailable due to scheduled maintenance, unscheduled outages, third-party disruptions, or force majeure events.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that AI outputs will be accurate or suitable for any specific purpose.
To the maximum extent permitted by law, Swaply LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising from or related to these terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) US $100.
You agree to indemnify, defend, and hold harmless Swaply LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these terms, (c) your violation of any third-party right (including right of publicity, copyright, or privacy rights), or (d) any content you upload or generate using Swaply.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
We may modify these terms at any time. Material changes will be communicated via email or a prominent notice on the site at least 30 days before they take effect. Continued use of Swaply after changes take effect constitutes acceptance. If you disagree with the changes, you may cancel your subscription before they take effect.
If any provision of these terms is found unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Swaply LLC regarding Swaply, superseding any prior agreements.
